Locations

The Macomb County Circuit Court has two locations:

The Circuit Court location is: 40 N. Main St., Mount Clemens, MI 48043

All Judges are located on N. Main in downtown Mt. Clemens. 

The Juvenile Division is: 10 N. Main St., Mount Clemens, MI 48043

 

Parking

There is a parking structure next to the Administration Building at 10 S. Main Street, Mount Clemens, MI. The cost is $1.00 per hour, which must be paid via debit or credit card as you depart the parking structure. There is metered angle parking in front of the court building for short visits. 

Court Hours

The hours of the Court shall generally be 8:00 a.m. to 4:30 p.m. 

In the following instances the business hours of departments of the court vary from standard business hours:

The hours for holding court in the courtrooms are from 8:00 a.m. to noon and 1:30 p.m. to 4:30 p.m., unless a judge directs that his or her hours of holding court are 8:30 a.m. to noon and 1:30 p.m. to 5:00 p.m. or unless otherwise ordered by the trial judge or the Chief Judge in a particular case.

Orders and judgments may be submitted to judges' clerks for signing and entry only during the hours of 8:30 a.m. to Noon and 1:30 p.m. to 4:30 p.m.

With the permission of the Chief Judge, specific offices of the court may maintain public service hours of 8:00 a.m. to 5:00 p.m. Court Administration is available to serve the public from 8:00 a.m. until 4:30 Monday through Friday.

Clerk of the Court

The Macomb County Clerk is the clerk for the Macomb County Circuit Court. The court section of the Clerk's Office maintains the court files, indexes and other records of the court and permits access to these records in accordance with the law. Computer terminals are available in the Court Section for the public to review court records. Copies of documents may be obtained from the file room of the Clerk's Office.

Filings

Lawsuits are initiated by filing the necessary documents with this department. All case related filings are done with the Clerk of the Court. The Court Section is located on the 1st floor of the Macomb County Court Building, 40 N. Main, Mount Clemens, MI 48043.

Filing Fees

Filing fees in the circuit court are set by statute and Michigan court rules. This link takes you to a website listing circuit court fees. This site is maintained by the State Court Administrative Office and is periodically updated. The fee for filing a motion is set by MCL 600.2529(1)(e). Motions are further governed by Michigan court rule 2.119(G). The wavier or suspension of filing fees is governed by MCR 2.002.

Motions

Cases may be brought to the attention of judges on miscellaneous motions under Michigan Court Rule 2.119. The motion day in the Macomb Circuit Court is Monday. In the event a Monday is a court holiday, motions will be held the next day, Tuesday. Motions are scheduled in the morning, except that the Family Division directs domestic relations motions in which the parties are representing themselves (called 'pro per') are scheduled on Monday afternoons at 1:30 p.m. and are heard by Friend of the Court referees. Court Officers

The Chief Judge of the Macomb County Circuit Court has appointed the following persons as independent contractor court officers to seize property or conduct evictions, pursuant to MCR 3.106. Under MCR 3.106(B)(1), the Macomb County Circuit Court provides that property shall be seized and evictions conducted only by: (a) court officers and bailiffs serving this Court; (b) Sheriffs and Deputy Sheriffs; (c) officers of the Department of State Police in an action in which the State is a party; and (d) police officers of an incorporated city or village in an action in which the city or village is a party.
