What is Michigan Proposal 1?

  • Proposal 1 legalizes the possession and use of marijuana for recreational purposes for residents 21 years or older. The measure creates an excise sales tax of 10 percent, which is levied on marijuana sales at retailers and microbusinesses. Revenue from the tax is allocated to local governments, K-12 education, and road and bridge maintenance.
  • Proposal 1 also legalizes the cultivation, processing, distribution, and sale of industrial hemp. Municipalities are allowed to ban or limit marijuana establishments within their boundaries. It was approved by Michigan voters on Nov. 6, 2018 and went into effect on Dec. 6, 2018.

This act does not authorize:

  • People to operate vehicles or other machinery under the influence of marijuana
  • Butane extraction in residential property
  • Possession in schools
  • Consumption in a place prohibited by the property owner
  • Consumption in public
  • Marijuana edibles that can appeal to children

The Cannabis Regulatory Agency regulates the state’s medical marijuana facilities and licensees, including growers, processors, transporters, provisioning centers and safety compliance facilities.

The Michigan Medical Marijuana Program (MMMP) is a state registry program within the Marijuana Regulatory Agency at the Michigan Department of Licensing and Regulatory Affairs. The program administers the Michigan Medical Marihuana Act as approved by Michigan voters on Nov. 4, 2008. The program implements the law to protect the public and assure the confidentiality of its participants.
