Warren man arraigned on 15 counts following car crash that killed one, injured four

A Warren resident was arraigned in connection with a car crash that killed a Detroit man and injured four others.

Mount Clemens, MI - Today a Warren resident was arraigned in connection with a car crash that killed a Detroit man and injured four others.

It is alleged that on Saturday, March 2, 2024, Xavier Fuggerson, age 33, was intoxicated and racing a Chevrolet Tahoe at a high rate of speed when he lost control of his Chevrolet Impala and hit the Tahoe on Groesbeck near Stephens in Warren. The Tahoe rolled over and the driver, Dennis Smith, died and four others were injured.

Xavier Fuggerson is charged with the following:

  • Count One: Operating a Motor Vehicle While Intoxicated Causing Death (15 year felony)

  • Count Two: Reckless Driving Causing Death (15 year felony)

  • Count Three: Operating While License Suspended Causing Death (15 year felony)

  • Count Four: Operating While Intoxicated Causing Serious Injury (five year felony)

  • Count Five:  Reckless Driving Causing Serious Injury (five year felony)

  • Count Six:  Operating While License Suspended Causing Serious Injury (five year felony)

  • Count Seven: Operating While Intoxicated Causing Serious Injury (five year felony)

  • Count Eight:  Reckless Driving Causing Serious Injury (five year felony)

  • Count Nine:  Operating While License Suspended Causing Serious Injury (five year felony)

  • Count Ten: Operating While Intoxicated Causing Serious Injury (five year felony)

  • Count Eleven:  Reckless Driving Causing Serious Injury (five year felony)

  • Count Twelve:  Operating While License Suspended Causing Serious Injury (five year felony)

  • Count Thirteen: Operating While Intoxicated Causing Serious Injury (five year felony)

  • Count Fourteen:  Reckless Driving Causing Serious Injury (five year felony)

  • Count Fifteen:  Operating While License Suspended Causing Serious Injury (five year felony

Fuggerson is also being charged as a habitual third offender.  He was arraigned in 37th Warren District Court where District Court Judge Suzanne Faunce set bond at $1 million cash/surety.  If released he must wear an alcohol and steel GPS tether, have no contact with any witnesses and have no alcohol or drugs.  A Probable Cause Hearing is scheduled for Thursday, March 14, 2024 at 9:00am.
