Florida man bound over to circuit court on twelve charges related to carjacking from Lifetime Fitness in Shelby Township

Mount Clemens, Ml - Macomb County Prosecutor Peter J. Lucido announced that Xavier Gardner, a 31-year-old Florida man, was bound over to Macomb County Circuit Court on multiple charges in relation to an October 2023 carjacking outside of Lifetime Fitness in Shelby Township, MI.

On Wednesday, August 27, 2025, Gardner was bound over to Circuit Court after a Preliminary Exam in the 41A Shelby Township District Court before Judge Stephen S. Sierawski. The Preliminary Exam took two days to complete. Gardner was bound over on the following charges. 

Count One: Carjacking, a life or any term of years felony

Count Two: Conspiracy to Commit Carjacking, a life felony

Count Three: Felony Firearm, a two-year felony, consecutive to main charge

Count Four: Armed Robbery, a life or any term of years felony

Count Five: Conspiracy to Commit Armed Robbery, a life felony

Count Six: Felony Firearm, a two-year felony, consecutive to main charge

Count Seven: Torture, a life or any term of years felony

Count Eight: Unlawful Imprisonment, a 15-year felony

Count Nine: Conspiracy to Commit Unlawful Imprisonment, a 15-year felony

Count Ten: Felony Firearm, a two-year felony, consecutive to main charge

Count Eleven: First-Degree Home Invasion, a 20-year felony

Count Twelve: Conspiracy to Commit First-Degree Home Invasion, a 20-year felony

Gardner will be arraigned In Macomb County Circuit Court on Thursday, September 18, 2025 before Judge Joseph Toia. 

It is alleged that on Monday, October 23, 2023, Xavier Gardner and five other suspects carjacked the victim at gunpoint, restrained him in his own vehicle and drove away. The suspects allegedly tortured the victim, drove to the victim’s house, and entered the residence. Sterling Heights Police were called to Lifetime Fitness when the carjacking occurred and went to the victim’s house. Gardner fled from police. Months later, he was located and extradited from Florida to Michigan. 

Four of the other suspects, Angel Andujar-Ruiz, Angel Pantoja, Renado Coleman, and Romeo Osorio are scheduled for a jury trial on Tuesday, October 28, 2025 before Judge Toia. 

The sixth suspect is in Florida facing federal charges. 

"The charges against this defendant reflect allegations of significant criminal conduct. We will continue to pursue and prosecute each individual alleged to have been involved in this case to the fullest extent of the law. We will work tirelessly to ensure that those who break the law are held accountable,” said Macomb County Prosecutor Peter J. Lucido.
