Final member of Venezuelan group bound over to circuit court

Mount Clemens, MI - Macomb County Prosecutor Peter J. Lucido announced 20-year-old Randy Hermoso was bound over on charges related to the alleged safe-breaking of an ATM in April 2025. He is the last of five defendants bound over to the circuit court in this matter.  All of the defendants are Venezuelan citizens.

On Monday, Sept. 23, 2025, a Preliminary Exam was conducted by Assistant Prosecuting Attorney Erica Clute-Cubbin at the 41A District Court in Sterling Heights, MI before Judge Kimberley A. Wiegand. After the hearing, Judge Wiegand bound Hermoso over to the Macomb County Circuit Court to face charges of Safe Breaking and Conspiracy to Commit Safe Breaking. Both charges carry a penalty of life or any term of years imprisonment. Hermoso will be arraigned at the circuit court before Judge Jennifer M. Faunce on Monday, Oct. 6, 2025, at 1:30 p.m. 

It is alleged that Hermoso was with four other individuals as one of them used tools to access an ATM on April 15, 2025. Dyfred Reyes-Palacios, Howard Jaen Gil, Jose Aguilar and Eyder Francia waived their preliminary exams and are also facing charges of Safe Breaking and Conspiracy to Commit Safe Breaking.  Francia has an additional charge of possession of burglar tools. Each of the men has a $250,000 cash/surety bond. U.S. Immigration and Customs Enforcement has detainers on the men.

My office will continue to pursue anyone who breaks the law in this county, and we will hold all individuals fully accountable to protect the safety and security of our community,” said Macomb County Prosecutor Peter J. Lucido.
