Mount Clemens, MI - Macomb County Prosecutor Peter J. Lucido announced that Terry Herman, a 35-year-old Clinton Township man, was arraigned on a charge of failing to pay child support after allegedly accruing an arrearage of over $15,000.
On March 2, 2016, Macomb County Circuit Court Judge Matthew S. Switalski ordered Herman to pay child support. It is alleged that Herman owes back child support in the amount of $15,271.40. He has had three Show Cause Hearings and two bench warrants were issued.
After exhausting all enforcement options and determining Herman has the ability to pay, the Macomb County Prosecutor’s Office charged Herman with failure to pay child support, a felony, which carries a potential penalty of up to four (4) years in prison.
On Monday, Sept. 15, 2025, Herman was arraigned in the 41B District Court in Clinton Township before Magistrate Ryan Zemke, who set bond at $3,818.00, cash only. A Probable Cause Conference is set for Tuesday, Sept. 23, 2025 at 8:30 a.m. before 41B District Court Judge Carrie Lynn Fuca.
“Mothers and fathers alike carry both a legal responsibility and a moral obligation to financially support their children. When someone intentionally ignores a court-ordered child support order, it robs children of the resources they need to thrive and places an unfair burden on the parent providing care. Our office remains committed to enforcing these obligations and ensuring accountability for those who refuse to meet their duty under the law,” said Macomb County Prosecutor Peter J. Lucido.
Prosecutor Lucido has proposed the creation of a Child Support Specialty Court, a pilot program aimed at helping parents behind on child support payments find work, pay arrears and avoid felony convictions. “Our goal is simple: get children the support they’re owed while addressing the barriers that keep parents from paying,” Lucido said.
Under Lucido’s direction, the office has focused on securing compliance rather than simply filing charges. The Family Division of the Macomb County Prosecutor’s Office oversees felony nonsupport cases where arrears exceed $5,000, payments have not been made for three consecutive months, and there is evidence that the noncustodial parent has the financial means to pay. Since 2022, the division successfully collected over $3.2 million for children from delinquent parents.
