MOUNT CLEMENS, MI - Macomb County Prosecutor Peter J. Lucido announced that 40-year-old Michael Weeks, of Burtchville, MI, was arraigned on a charge of failing to pay child support after finding that he had the ability to pay and all efforts to work with him on payment options were exhausted.
It is alleged that Weeks has a Macomb County Friend of the Court file going back to 2014. There have been several child support orders and modifications. The most recent was entered on December 17, 2025, by Macomb County Circuit Court Judge Matthew S. Switalski who ordered Weeks to pay child support. It is alleged that Weeks failed to comply with the support orders and accrued a child support arrearage of $35,338.80. It is further alleged that the last payment made was in October 2025. There have been four show cause hearings, and three prior bench warrants issued to obtain compliance.
After determining that Weeks has the ability to pay, and with no enforcement options remaining or being effective, the Macomb County Prosecutor’s Office charged Weeks with the following:
- Failure to Pay Child Support, a felony, which carries a potential penalty of up to four years in prison
- Habitual Offender – Third Offense Notice, an aggravating sentencing factor allowing the maximum sentence to be increased to as much as double the normal maximum.
These are the maximum criminal charges available based upon the evidence presented to date.
On Thursday, June 11, 2026, Weeks was arraigned before Magistrate Ryan Zemke in the 41-B District Court in Clinton Township, MI. Magistrate Zemke set Weeks’ bond at $8,834.00, cash only.
Weeks is scheduled for a Probable Cause Conference before Judge Jacob Femminineo, Jr. at the 41-B District Court on Monday, June 22, 2026, at 8:30 a.m.
"Children depend on the consistent support of both parents to meet their basic needs and build a secure future. When an individual chooses to ignore a court-ordered child support obligation, the consequences extend far beyond a financial matter—they can affect a child's health, education, and overall quality of life. Our office remains committed to enforcing the law and ensuring that parents are held accountable for their responsibilities. We will continue working diligently to safeguard the well-being of children and provide families with the support and stability they deserve," said Peter J. Lucido.
Prosecutor Lucido proposed the creation of a Child Support Specialty Court, a pilot program aimed at helping parents behind on child support payments find work, pay arrears and avoid felony convictions. “Our goal is simple: get children the support they’re owed while addressing the barriers that keep parents from paying,” Lucido said. The pilot court has launched and is already working with some individuals as they seek acceptance into the program.
Under Lucido’s direction, the office has focused on securing compliance rather than simply filing charges. The Family Division of the Macomb County Prosecutor’s Office oversees felony nonsupport cases where arrears exceed $5,000, payments have not been made for three consecutive months, and there is evidence that the noncustodial parent has the financial means to pay.
Since 2022, the division successfully collected over $5 million for children from delinquent parents.
