Detroit Man Arraigned for Allegedly Not Paying Child Support, Owing More Than $42K

Detroit Man Arraigned for Allegedly Not Paying Child Support, Owing More Than $42K

Mount Clemens, MI - Mark S. Leroy II, age 40, has been arraigned for failing to pay child support on his minor children.

On Monday, April 22, 2013, Mark S. Leroy II was ordered by Macomb County Circuit Court Judge Kathryn Viviano to pay $544.00 per month in child support for his two minor children.  In 2020, a modification was made for a third child increasing the payment to $717.00 per month.  He allegedly owes $42,118.18  in back child support for his three children.  Mark S. Leroy II has had five show cause hearings and four bench warrants issued in this case.

The Macomb County Prosecutor’s Office has charged Mark S. Leroy II with Failing to Pay Child Support, a four year felony, after the Macomb County Friend of the Court exhausted their efforts to enforce the court order of paying child support. 

Mark S. Leroy II was arraigned on Wednesday, September 11, 2024 in 41B Clinton Township District Court by Magistrate Ryan Zemke where set bond at $10,529.00.  A Probable Cause Hearing is scheduled for Monday, September 23, 2024 at 8:30 am by District Court Judge Jacob Femminineo, Jr.

“It is my responsibility to ensure that parents fulfill their legal obligations to support their children. No child should suffer because of a parent's failure to provide financial support, and we will pursue every available legal avenue to rectify this situation and ensure the well-being of these children," said Macomb County Prosecutor Peter J. Lucido.

The Macomb County Prosecutor’s Office Family Division investigates and prosecutes felony nonsupport cases which are cases where the noncustodial parent owes more than $5,000 in child support. In order for your case to qualify for review: there must be an arrearage of $5,000 or more, failure to pay for three consecutive months, the noncustodial parent has the ability to pay the court ordered child support amount and lives in Michigan. The goal of this prosecution is to help ensure that the children are financially supported by both parents and to ensure that justice is served according to the law.
